Refunds & Digital Products Policy

This Refunds & Digital Products Policy applies to digital music products purchased through Soundoos.com (“Soundoos”, “we”, “us”, or “our”).

By purchasing a digital music product from Soundoos.com, you acknowledge and agree to the terms set out below.

1. Digital Products

Soundoos.com offers digital music products that may be purchased and downloaded electronically.

Digital products may include, without limitation:

  • Music tracks
  • Audio files
  • Instrumental or vocal recordings
  • AI-generated or AI-assisted music
  • Other digital audio content made available for purchase by Soundoos.com

No physical product is shipped to the customer.

2. Immediate Digital Delivery

After a successful purchase, the purchased digital product may be made available to the customer for immediate download.

By completing the purchase, the customer may expressly request immediate delivery of the digital content.

Where required by applicable consumer law, the customer will be asked at checkout to expressly acknowledge that the provision of the digital content begins immediately and that, once the provision begins, the statutory right of withdrawal may be lost.

The relevant consent checkbox must not be pre-selected.

3. Refunds

Due to the nature of digital products, purchases are generally non-refundable once the purchased digital file has been made available to the customer for download or the digital content has otherwise been supplied.

This applies because the customer is receiving a digital product that can be accessed, downloaded, copied or used immediately after purchase.

Nothing in this Policy excludes or limits any mandatory consumer rights that cannot legally be excluded under applicable law.

4. Right of Withdrawal for Digital Content

For consumers to whom statutory withdrawal rights apply, applicable law may provide a right of withdrawal for certain distance contracts.

However, for digital content that is not supplied on a tangible medium, the statutory right of withdrawal may cease once:

  1. the customer has expressly consented to the immediate performance of the contract;
  2. the customer has expressly acknowledged that the right of withdrawal will be lost once performance begins; and
  3. the provision of the digital content has begun.

Where these conditions are legally applicable and have been properly obtained, Soundoos may therefore refuse a withdrawal request after the digital content has been made available.

5. Damaged, Corrupted or Inaccessible Digital Files

If a purchased digital file is technically defective, corrupted, incomplete or cannot reasonably be downloaded due to a technical problem attributable to Soundoos, the customer should contact us as soon as possible.

Soundoos may, depending on the circumstances and applicable law:

  • provide a replacement file;
  • restore access to the purchased download;
  • provide another technically appropriate solution; or
  • provide a refund where required by applicable law.

A technical problem must not be confused with a change of mind or dissatisfaction with the creative characteristics of a digital music product.

6. Incorrect or Duplicate Purchases

If a customer accidentally purchases the same digital product more than once, the customer should contact Soundoos as soon as possible.

Soundoos may review the transaction and determine whether a refund or another appropriate solution is available.

Where the digital product has already been delivered or downloaded, any refund will remain subject to applicable law and the circumstances of the transaction.

7. Dissatisfaction With the Music

Because digital music products are made available for immediate use, a customer generally cannot request a refund solely because:

  • they do not like the music after purchase
  • the music is different from what they expected based on their personal taste
  • they changed their mind after downloading the file
  • they no longer need the music
  • they purchased the wrong track without a technical defect or
  • they subsequently decide not to use the music

Nothing in this section limits mandatory rights available to consumers under applicable law.

8. Purchased Music – Permitted Use

A purchased music file is licensed to the customer for use according to the Soundoos.com Terms of Use and any additional license terms displayed with the specific product.

Unless otherwise stated for a particular product, purchased music may generally be used for:

  • private listening
  • public playback
  • background music in businesses and professional premises
  • shops, hotels, restaurants, cafés and similar premises
  • gyms and other professional environments
  • events and other public or private activities
  • websites
  • YouTube and other online video platforms
  • social media
  • digital content and online productions

Any mandatory rights, licenses, fees or obligations imposed by applicable law or by third-party rights holders remain applicable where relevant.

9. Television and Cinema

Use of purchased Soundoos music in television or cinema productions requires prior specific authorization from Soundoos.com.

A standard purchase of a digital music file does not automatically grant permission to use the music:

  • in a television programme
  • in a television commercial
  • in a cinema film
  • in a theatrical film production
  • as part of a television network production or
  • as part of a cinema or theatrical release

Customers wishing to use a Soundoos track in television or cinema should contact Soundoos before using the music and obtain the appropriate written authorization or license.

Additional licensing terms or fees may apply.

10. Prohibited Distribution

Purchasing a digital music product does not permit the customer to distribute the original digital file as an independent product.

The customer may not, without authorization:

  • resell the original music file
  • redistribute the original file
  • upload the original file to file-sharing or torrent services
  • make the original file available for download by third parties
  • provide the original file to music libraries or stock-music marketplaces
  • sublicense or sell the original file to another person or company or
  • represent the original file as their own downloadable music product

The customer may use the purchased music within permitted projects and content, but the original music file itself may not be commercially redistributed as a standalone digital product.

11. Ownership and License

A purchase of a digital music product does not constitute a transfer of ownership of Soundoos.com’s intellectual property or any rights that Soundoos is legally entitled to license.

The customer receives the applicable rights of use described in the Terms of Use and any product-specific license terms.

The purchase price therefore represents payment for access to the digital product and the applicable license to use it, rather than a transfer of intellectual property ownership.

12. AI-Generated Music

Some Soundoos music may be created using artificial intelligence, AI-assisted tools, or other automated music-generation technologies.

The use of AI technology does not alter the customer’s obligations under this Policy or the Soundoos.com Terms of Use.

Soundoos does not represent that every element of every AI-generated recording necessarily qualifies for copyright protection in every jurisdiction. The legal status of AI-generated material may depend on applicable law, the degree of human creative contribution, the technology used, and other circumstances.

The customer’s permitted use of a purchased track is therefore governed primarily by the contractual license granted by Soundoos and the applicable terms accompanying the product.

13. No Refund for Unauthorized Use

A refund will not normally be available because a customer discovers after purchase that a particular intended use is not permitted under the applicable license.

Customers are responsible for reviewing the permitted-use terms before purchasing a digital product, particularly if they intend to use the music in television, cinema or another production requiring a separate license.

14. Consumer Rights

Nothing in this Policy is intended to exclude, restrict or waive any mandatory statutory consumer rights that apply to the customer under applicable law.

Where applicable law provides remedies for defective, non-conforming or improperly supplied digital content, those rights remain unaffected.
